Terms and Conditions – Ambsvisuals

These terms and conditions apply to all photo sessions and wedding coverages carried out by Ambsvisuals. By making a booking, the client agrees to these terms and conditions, even without a physical signature.

1. Booking & Payment

A booking is only confirmed upon written agreement and payment of a 20% deposit of the total fee.
The remaining balance must be paid in full before any photos are delivered.
If payment is not received on time, Ambsvisuals reserves the right to postpone delivery.

2. Payment Reminders & Late Payment

If payment is not received within 2 weeks after the due date, a first reminder will be sent.
If the payment remains outstanding after 4 weeks, a late fee of €25 will be added to the invoice.
Further non-payment may result in legal action, and any resulting costs will be charged to the client.

3. Travel Costs & Location Fees

The first 10 km from Geraardsbergen are included.
After that, a travel fee of €0.42/km will be charged.
Parking fees, entrance tickets, or other location-related costs are the client’s responsibility.

4. Session Duration & Photographer Care

For bookings lasting 6 hours or more, the client must provide a hot meal for the photographer.
Drinks must be available for all wedding packages, regardless of duration.
If these provisions are not made, Ambsvisuals may schedule breaks or charge additional fees.

5. Image Delivery

A preview of 10–20 photos will be delivered within 7 days after the session.
The full gallery will be delivered within 4 to 6 weeks, provided the total balance has been paid.
Images are delivered via a secure online gallery, available for at least 10 years.
RAW files are not shared, but are securely stored for a period of 5 years.

6. Image Selection, Style & Editing

Ambsvisuals selects and edits the best images in her signature style.
By booking, the client agrees to the creative style as seen on the website and social media.
Additional edits or retouching are available upon request and may incur extra fees.

7. Copyright & Image Use

All images remain the intellectual property of Ambsvisuals.
The client receives a non-exclusive license for personal use only.
Ambsvisuals reserves the right to use the images for website, social media, portfolio, publications, or contests, unless the client explicitly objects in writing beforehand.
Commercial use by the client requires prior written permission.

8. Damage & Liability

If equipment of Ambsvisuals is damaged by guests or third parties, the full repair or replacement cost will be charged to the client.
Ambsvisuals is not liable for delays or failed delivery due to force majeure, such as illness, extreme weather, or technical failure.
In case of force majeure, a suitable replacement will be arranged or the payment will be refunded.

9. Cancellation by the Client

If cancelled more than 30 days before the scheduled date, the deposit is non-refundable.
If cancelled within 30 days, 50% of the total fee will be charged.
Cancellations must be submitted in writing or via email.

10. Privacy & Data Protection

Client data will be used solely for communication and service delivery, in compliance with GDPR regulations.
Images are securely stored and will not be shared with third parties without consent.

11. Legal

These terms are governed by Belgian law.
In case of disputes, only the courts of Oudenaarde have jurisdiction.
Exceptions or changes to these terms are only valid in written agreement.

12. Acceptance of Terms

By booking a photo session or wedding coverage with Ambsvisuals, the client fully accepts these terms and conditions, even without a physical signature.
